Case dismissed! – patent invalid under Section 101 in view of Alice.

Roberts IP Law working in conjunction with The Law Office of Manuel de la Cerra just obtained dismissal of a federal patent lawsuit at the initial pleading stage with a Rule 12 Motion to Dismiss, prior to claim construction. We successfully persuaded the Court that the patent was invalid under Section 101 because it was directed to an “abstract idea” under the case law emerging from the Supreme Court’s landmark ruling in Alice.

This case stands for the proposition that manipulating data with standard computer systems is not patentable.
